Draft Terms \u2014 Not Legal Advice

These Terms of Service are a draft prepared by the Wake Bid team. They have not been reviewed by qualified legal counsel. They should not be relied upon for enforcement until reviewed by a qualified attorney.

1. Eligibility

You must be legally able to enter into binding agreements to use Wake Bid. If you are under 18, you may not use Wake Bid independently for transactions. Wake Bid does not knowingly allow minors to enter into binding purchase or sale agreements on the platform.

By creating an account or using Wake Bid, you represent that you are of legal age in your jurisdiction and that all information you provide is accurate.

2. Wake Bid’s Role

Wake Bid is a marketplace and listing platform that connects buyers and sellers of personal watercraft. Wake Bid also offers an optional in-person certification service for sellers.

Wake Bid does not own the personal watercraft listed on the platform unless explicitly stated otherwise. Wake Bid is not a dealer, broker, or party to any transaction between buyers and sellers. Wake Bid does not hold funds on behalf of buyers or sellers.

3. Regular Listings

Regular Wake Bid listings contain seller-provided information and are not automatically physically inspected by Wake Bid. The seller is responsible for the accuracy of all listing information, including photos, hours, condition, HIN, and title status.

Wake Bid reviews submitted listings for completeness and policy compliance before publishing them, but this review does not verify the accuracy of the seller’s claims unless the listing is Wake Bid Certified.

4. Wake Bid Certified Listings

Wake Bid Certified listings receive only the specific in-person checks documented in their individual certification report. The certification report describes exactly what Wake Bid reviewed and what was observed.

Certification is not:

• A warranty

• A mechanical guarantee

• A guarantee of future reliability

• A guarantee that every hidden defect was discovered

A Wake Bid certification documents the specific observations and tests shown in the certification report. It is not a warranty or guarantee of future condition or performance.

5. Payments

Wake Bid uses third-party payment processors for any payments made through the platform. The specific payment processor used may change over time.

Payments between buyers and sellers for the purchase of a watercraft are arranged directly between the buyer and seller. Wake Bid is not a party to those payments and does not hold or transfer purchase funds.

6. Buyer Responsibility

Buyers should independently evaluate the watercraft, documentation, transaction terms, and suitability before purchase. Wake Bid does not verify the accuracy of regular listing information.

Buyers are responsible for inspecting the watercraft in person and independently verifying title, HIN, condition, hours, and ownership before sending any payment. Never wire funds without confirming the seller’s identity and the title status.

7. Seller Responsibility

Sellers must provide accurate information and disclose known material defects. Sellers are prohibited from knowingly providing false:

• Ownership claims

• Hours

• Condition information

• HIN information

• Photos

• Title information

Sellers must disclose known flaws, damage history, and mechanical problems. Disclosures cannot be silently removed after bidding begins.

8. Prohibited Conduct

The following conduct is prohibited on Wake Bid:

• Fraud

• Fake listings

• Stolen property

• Impersonation of another person or business

• Payment scams

• Manipulation of reviews or marketplace data

• Misuse of uploaded identity documents

Wake Bid may investigate and take action against any account engaged in prohibited conduct, including removing listings, suspending accounts, and reporting illegal activity to authorities.

9. Listing Removal

Wake Bid may reject, remove, suspend, or investigate any listing or account that violates these Terms or platform rules. Wake Bid may request additional information or photos before approving a listing.

10. Fees

Creating a listing on Wake Bid is currently free.

WakeBid Certified pricing: WakeBid Certified is $50, which covers the in-person inspection and the Certified Report. The price is shown before you schedule.

Transaction fees: Pricing will be disclosed before the user commits to the service.

Wake Bid reserves the right to introduce fees in the future. Any new fees will be disclosed before a user commits to the service.

11. Disputes

If you have a dispute about a marketplace transaction, contact Wake Bid at wakebidteam@gmail.com. Wake Bid may review the situation and provide information or assistance, but Wake Bid does not guarantee that it will resolve every buyer-seller disagreement.

Wake Bid is not a party to transactions between buyers and sellers and is not responsible for enforcing agreements between them.

12. Limitation of Liability

Wake Bid is a marketplace that connects buyers and sellers. Wake Bid does not own, store, or transport the items listed and is not a party to any transaction.

Wake Bid does not provide buyer protection, guaranteed titles, financing, shipping, or insurance. Wake Bid is not liable for the accuracy of seller-provided information in regular listings, the condition of any watercraft, or the outcome of any transaction between buyers and sellers.

To the maximum extent permitted by law, Wake Bid’s liability is limited to the fees you have paid to Wake Bid, if any.

13. Intellectual Property

The Wake Bid name, logo, and branding are the property of Wake Bid. You may not use Wake Bid branding without permission.

Users retain ownership of the photos and content they upload to their listings. By uploading content, you grant Wake Bid a license to display it on the platform for the purpose of operating the marketplace.

14. Account Termination

Wake Bid may suspend or terminate an account at any time if the user violates these Terms, engages in prohibited conduct, or for any other reason Wake Bid determines is appropriate.

15. Changes to These Terms

Wake Bid may update these Terms from time to time. The effective date below indicates when the Terms were last updated. Continued use of Wake Bid after changes take effect constitutes acceptance of the updated Terms.
